CITY <br /> LICENSE TO USE CITY PROPERTY <br /> THIS LICENSE AGREEMENT (the"License"),between the City of Everett as <br /> Grantor(the "City) and Snohomish County Public Utility District, 1802 75TH ST W, <br /> Everett, WA 98203, as the Grantee ("PUD"), relates to an approximately 40' X 40' area <br /> of property owned by the City located underneath the West Marine View Drive Bridge at <br /> approximately 21St Street,Everett,WA(the"Property"). <br /> RECITALS <br /> A. PUD desires to utilize property owned by the City for employee and <br /> contractor parking while performing maintenance and construction work off site at a <br /> nearby electrical substation facility,the"Project". <br /> B. The City is willing to grant PUD authority to use the City's property upon <br /> certain terms and conditions. <br /> AGREEMENT <br /> In consideration of mutual benefits and other good and valuable consideration herein,the <br /> receipt and sufficiency of which is hereby expressly acknowledged,the City licenses <br /> PUD to use the Property upon the following terms and conditions: <br /> Section 1. LICENSED PROPERTY. The specific area of property owned by the <br /> City, and subject to this License, is an approximately one half acre area and is more fully <br /> set forth as depicted in Exhibit A and is attached hereto. <br /> Section 2. TERM. This License shall be effective beginning May 30, 2016, and <br /> shall expire on December 31, 2016,unless terminated earlier upon 30-days' notice per <br /> Section 7,below. <br /> Section 3. COMPENSATION. In exchange for PUD's use of the Property,PUD <br /> will grant to City a Limited Use Permit for the City to install a rain garden infiltration <br /> system immediately south of 52nd Street SE on a portion of the PUD owned property <br /> identified as Snohomish County Assessor's Parcel Number 29053200304100. <br /> Section 4. AUTHORIZED USE. PUD may only use the Property for the purpose of <br /> vehicular parking. Incident to this authorized use,PUD may install temporary fencing in <br /> conformance with Section 16,below. At a minimum PUD shall secure and restrict access <br /> to the Property by the use of a locking chain or cable that is attached to ecology blocks. <br /> page 1 <br />
