�. e <br /> CITY <br /> LICENSE TO USE CITY PROPERTY <br /> THIS LICENSE AGREEMENT (the"License"),between the City of Everett as <br /> Grantor(the"City) and Schack Art Center, 2921 Hoyt Ave, Everett, WA 98201 as the <br /> Grantee("Schack"), relates to the city owned parking lot located at the northeast corner <br /> of 26th Street and W. Marine View Drive, Everett, WA (the"property"). <br /> RECITALS <br /> A. Schack desires to utilize the property for vehicle parking use during the <br /> 2016 Fresh Paint Festival ("Event"). <br /> B. The City is willing to grant Schack authority to use the City's property <br /> upon certain terms and conditions. <br /> AGREEMENT <br /> In consideration of mutual benefits and other good and valuable consideration, the receipt <br /> and sufficiency of which is hereby expressly acknowledged, the City licenses Schack to <br /> use the Property upon the following terms and conditions: <br /> Section 1. LICENSED PROPERTY. The specific area of property owned by the <br /> City, and subject to this License, is legally described as LOTS 5 THRU 16, BLOCK 558, <br /> PLAT OF EVERETT DIV. G, as filed for record under Vol. 4, Page 41, records of <br /> Snohomish County, State of Washington. <br /> Section 2. TERM. This License shall be effective beginning at 6:00 A.M. August <br /> 20, 2016, and shall expire at midnight on August 21, 2016, unless terminated earlier per <br /> Section 7,below. <br /> Section 3. Intentionally Omitted. <br /> Section 4. AUTHORIZED USE. Schack may only use the property for the purpose <br /> of vehicle parking in conjunction with the Event. <br /> Section 5. INDEMNIFICATION. Schack hereby agrees to defend, indemnify and <br /> hold the City harmless from any and all Claims for injury to people or damage to <br /> property arising out of or related to this License. This defense and indemnification <br /> obligation shall survive any termination, revocation or expiration of this Agreement.
