ORDINANCE NO. 2708-03 <br /> AN ORDINANCE AMENDING ORDINANCE NO. 1671-89 (EMC TITLE 19), AS <br /> AMENDED, DEFINING AND ESTABLISHING LOCATIONAL REQUIREMENTS FOR <br /> OPIATE SUBSTITUTION TREATMENT FACILITIES, AND REPEALING ORDINANCE <br /> NO. 2678-03. <br /> WHEREAS, the City Council does find: <br /> 1. The City Council adopted Ordinance No. 2678-03 on February 18, 2003, establishing a <br /> moratorium on the establishment of drug and alcohol treatment facilities to provide for <br /> sufficient time to determine whether additional land use regulations are necessary to <br /> minimize the adverse social, economic or environmental impacts of such facilities; and <br /> 2. The Everett Municipal Code does not include regulations that establish permitted land <br /> use classifications and development standards for drug and alcohol treatment facilities, <br /> nor does it include regulations that establish permitted land use classifications and <br /> development standards for opiate substitution treatment facilities; and <br /> 3. The City Council held a public hearing on April 16, 2003 to take testimony regarding the <br /> moratorium on drug and alcohol treatment facilities; and <br /> 4. The City Council clarified that drug and alcohol treatment facilities located in downtown <br /> Everett that offer counseling services only, that are not located on the street level of the <br /> building, and that do not dispense medications for treatment of patients addicted to drugs <br /> or alcohol are exempt from the moratorium established by Ordinance No. 2678-03; and <br /> 5. There is a pending application before the Drug, Alcohol and Substance Abuse (DASA) <br /> Division of the State Department of Social and Health Services for an opiate substitution <br /> treatment facility in Everett; and <br /> 6. An opiate substitution treatment facility in Everett is subject to the moratorium on drug <br /> and alcohol treatment facilities established by Ordinance No 2678-03; and <br /> 7. The City has examined existing opiate substitution treatment facilities located in other <br /> cities in Washington and has considered the experiences of those communities in <br /> addressing social, economic or environmental impacts associated with such facilities; and <br /> 8. The City has reviewed regulations and guidelines promulgated by the Washington <br /> Department of Social and Health Services related to opiate substitution treatment <br /> facilities; and <br /> 9. The City has reviewed studies related to the effectiveness of opiate substitution treatment; <br /> and <br /> 10. The City has reviewed and considered the information related to the number of <br /> individuals residing in Everett and Snohomish County needing treatment for opiate <br /> substitution treatment and the geographic distribution of the areas in which such <br /> individuals reside; and <br />
