�ti <br /> 14111 <br /> ORDINANCE NO. 2715-03 <br /> AN ORDINANCE concerning alcohol <br /> at the City's golf courses, amending Section <br /> 1(E) of Ordinance No. 2625-02 (EMC 9.06.200E) <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION 1: That Section 1(E) of Ordinance No. 2625-02 (EMC 9.06.200E) <br /> which reads as follows: <br /> The sale of beer and wine by authorized concessionaires shall <br /> be permitted upon execution of a modification of the contract <br /> between the city and such concessionaires increasing the city's <br /> percentage share of revenues from beverage cart alcohol sales from <br /> thirty-five percent to forty-five percent.. <br /> Be and the same is hereby amended to read as follows: <br /> The sale of beer and wine by authorized concessionaires shall <br /> be permitted in conformance with an agreement between the City <br /> and such concessionaires. The revenue from such sales shall be <br /> split between the concessionaire and the City in accordance with <br /> the terms of the agreement. <br /> SECTION 2: Savings. <br /> Nothing contained herein shall be construed as abating any action now pending <br /> under or by virtue of any ordinance of the City; or as discontinuing, abating, <br /> modifying or altering any penalty accrued or to accrue, or as affecting the right or <br /> liability of any person, firm or corporation, or as waiving any right of the City <br /> under any ordinance or provision thereof in force at the time of passage of this <br /> ordinance. <br /> SECTION 3: Validity. <br /> Should any section, subsection, paragraph, sentence, clause or phrase of this <br /> ordinance or its application to any person or situation be declared unconstitutional <br /> or invalid for any reason, such decision shall not affect the validity of the <br /> remaining portions of this ordinance or its application to any other person or <br />
