�ti 14111 ORDINANCE NO. 2715-03 AN ORDINANCE concerning alcohol at the City's golf courses, amending Section 1(E) of Ordinance No. 2625-02 (EMC 9.06.200E) THE CITY OF EVERETT DOES ORDAIN: SECTION 1: That Section 1(E) of Ordinance No. 2625-02 (EMC 9.06.200E) which reads as follows: The sale of beer and wine by authorized concessionaires shall be permitted upon execution of a modification of the contract between the city and such concessionaires increasing the city's percentage share of revenues from beverage cart alcohol sales from thirty-five percent to forty-five percent.. Be and the same is hereby amended to read as follows: The sale of beer and wine by authorized concessionaires shall be permitted in conformance with an agreement between the City and such concessionaires. The revenue from such sales shall be split between the concessionaire and the City in accordance with the terms of the agreement. SECTION 2: Savings. Nothing contained herein shall be construed as abating any action now pending under or by virtue of any ordinance of the City; or as discontinuing, abating, modifying or altering any penalty accrued or to accrue, or as affecting the right or liability of any person, firm or corporation, or as waiving any right of the City under any ordinance or provision thereof in force at the time of passage of this ordinance. SECTION 3: Validity. Should any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation be declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance or its application to any other person or
