/..6/SF"Am <br /> tival.11 <br /> ORDINANCE NO. 3075-08 <br /> An Ordinance amending Ordinance No. 2842-05 to approve a three-year budget for the <br /> existing downtown Business Improvement Area(BIA) and extend the term of the BIA <br /> and existing special assessment levy for an additional year beyond its five-year term <br /> Whereas, the City Council, pursuant to Resolution No. 6019, adopted May 14, 2008, <br /> declared its intent to approve a three-year budget for the existing downtown Business <br /> Improvement Area(BIA) and extend the term of the BIA and existing special assessment <br /> levy for an additional year beyond its current five-year term; and <br /> Whereas, as provided in Resolution No. 6019, prior to the adoption of this Ordinance, <br /> the City Council held a public hearing on June 4, 2008, in the Everett City Hall Council <br /> Chambers, to consider the three-year budget for the existing BIA, and the extension of <br /> the term of the existing BIA and the special assessment levy for one additional year <br /> beyond its current five-year term; and <br /> Whereas, it is necessary to amend certain sections of Ordinance No. 2842-05 so that they <br /> are consistent with the intent expressed in Resolution No. 6019; <br /> NOW, THEREFORE BE IT ORDAINED BY THE CITY OF EVERETT: <br /> Section 1. Section 13 of Ordinance No. 2842-05, which reads as follows: <br /> The activities, services and projects to be funded with the special assessment proceeds for <br /> the first three years, and the three year budget as set forth in the materials on file with the <br /> City Clerk, are hereby approved. There is a hereby appropriated and authorized to be <br /> expended from the District Fund the sum of $175,500, or so much thereof as may be <br /> necessary, for the purposes, projects, activities, and services approved for the each or the <br /> next three years BIA fiscal years (June 1, 2005 through June 30, 2008.). Unless otherwise <br /> authorized by the City, the total amount to be specially assessed and expended in <br /> subsequent years shall be as set forth in the budget approved by the City. The particular <br /> program and services to be provided for each subsequent period and the amount of <br /> funding thereof shall be as approved by ordinance of the City Council, after notice and <br /> hearing as provided by Section 12 hereof. The Mayor is hereby authorized and directed to <br /> contract with the downtown Everett Association, or similar organization, to administer <br /> projects and activities for the first year. Thereafter, the City may continue each year to <br /> contract with the Downtown Everett Association, or similar organization to administer <br /> the forthcoming annual program, unless a suitable successor organization is <br /> 1 <br />
