OP(etyr:Aa <br /> ORDINANCE NO. 3100-08 <br /> AN ORDINANCE amending Ordinance No. 1561-89, as amended by Ordinances No. <br /> 1816-91, 2084-95 and 2688-03, authorizing an increase of sewer utility funding to <br /> encourage installations of sanitary sewers in unsewered areas of the City and <br /> establishing rates and charges related thereto. <br /> WHEREAS, Ordinance No. 1561-89 and its amendments offer limited funding assistance to <br /> single-family residences, businesses and City Water Utility customers toward the cost of <br /> constructing public sanitary sewers, the stipulated payment amount of this funding assistance <br /> was established in 1989 at $4,000 and has not been adjusted to reflect current construction <br /> costs; and <br /> WHEREAS, increasing the payment amount in proportion to construction cost escalation <br /> since 1989 will restore the value of this financial incentive as it was originally intended; and <br /> WHEREAS, some existing single-family residences,businesses and City Water Utility <br /> customers are connected to the city sewer system by means of private lines, side sewers or <br /> other connections that are not in conformance with EMC Title 14. In some instances, these <br /> non-conforming connections would benefit from extensions of new public sewers to meet <br /> code requirements and to enhance public health, safety and the environment. <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Section 1 of Ordinance No. 1561-89 as amended by Ordinance 2688-03, which <br /> reads as follows: <br /> Section 1: The Everett Sewer Utility is authorized to pay up to $4,000 per single-family <br /> residence or business or other City Water Utility customer on a septic system to encourage <br /> formation of Local Improvement Districts for the sole purpose of constructing public sanitary <br /> sewer or which include the construction of public sanitary sewers. <br /> In addition, the Everett Sewer Utility is authorized to pay up to $4,000 per single- <br /> family residence or business or other City Water Utility customer on a septic system toward <br /> the City's cost of constructing public sanitary sewers in small, isolated areas within the City's <br /> corporate limits that are not served by sanitary sewers. <br /> In all cases, the $4,000 City payments shall apply only to single-family residences or <br /> businesses or other City Water Utility customer on a septic system that exist at the time the <br /> public sewer mains are constructed. Also, the$4,000 payments shall be made in the form of <br /> credits deducted from the property owners' proportionate shares of the City's cost of <br /> constructing the sanitary sewers. The $4,000 payments shall not be rebates or cash <br /> disbursements to new sewer customers. Further, the $4,000 payments apply only to single- <br /> family residences or businesses or other City Water Utility customer on a septic systems <br /> benefiting from public sanitary sewer mains constructed by City crews or by construction <br /> contractors officially retained by the City of Everett. <br />
