ORDINANCE NO. 3106-08 <br /> AN ORDINANCE relating to Automated Traffic Safety Cameras, <br /> adding a new chapter to the Everett Traffic Code, <br /> Title 46 of the Everett Municipal Code. <br /> WHEREAS,the state legislature has granted authority to cities to use automated traffic <br /> safety cameras for issuance of notices of infraction, subject to certain statutory <br /> requirements; and <br /> WHEREAS,the City Council has been advised that according to the National Highway <br /> Administration data, failure to stop at red lights is one of the primary causes of crashes at <br /> signalized intersections, which result in fatalities, injuries and property damage; and <br /> WHEREAS,the City Council recognizes the value of implementing an automated traffic <br /> enforcement program in furtherance of city goals of creating a safer environment for its <br /> citizens and potentially reducing deaths, injuries and property damage; <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Definition. <br /> For purposes of this chapter, "automated traffic safety camera" means a device that <br /> uses a vehicle sensor installed to work in conjunction with an intersection traffic <br /> control system, a railroad grade crossing control system or a speed measuring device, <br /> and a camera synchronized to automatically record one or more sequenced <br /> photographs, microphotographs, or electronic images of the rear of a motor vehicle <br /> whenever a vehicle fails to stop when facing a steady red traffic control signal or an <br /> activated railroad grade crossing control signal, or exceeds a speed limit to a school <br /> speed zone as detected by a speed measuring device. <br /> Section 2: Authorized use. <br /> A. City law enforcement officers and persons commissioned by the Chief of Police <br /> are authorized to use automated traffic safety cameras and related automated systems <br /> only to detect and record the image of: <br /> 1. Stoplight violations at the intersection of two arterials; <br /> 2. Railroad crossing violations; and <br /> 3. School speed zone violations. <br />
