ORDINANCE NO. 3142-09 An Ordinance Relating to Unlawful Bus Conduct, Amending Ordinance No. 1895- 92 as Amended (EMC 10.49). WHEREAS, the State legislature amended RCW 9.91.025, Unlawful Bus Conduct to expand the list of prohibited conduct at a transit facility or on a transit vehicle to include, among other things, possessing or tendering unused media fare, falsely claiming to be a transit official or employee, gambling, roller skating and skate boarding and engaging in conduct that is inconsistent with the intended use and purpose of the transit facility, station or vehicle and refusing to obey the commands of an agent of the transit authority or peace officer to stop the conduct; and WHEREAS, the City Council finds that the amendments are appropriate for the City of Everett; and WHEREAS, the City Council finds that violators of the unlawful bus conduct ordinance and other transit regulations sometimes refuse to identify themselves or provide a false identity to transit officials, which conduct obstructs the transit official from properly enforcing Everett Transit rules and regulations and promoting a safe environment at transit facilities and on transit vehicles and should be prohibited; and WHERAS, the City Council finds that Chapter 10.49 EMC, Unlawful Bus Conduct should be entitled "Unlawful Transit Conduct" to more accurately reflect the scope of the Ordinance; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1. Section 1 of Ordinance No. 1895-92, which reads: A new chapter is added to the Everett Criminal Code, EMC title 10, to be entitled "Unlawful Bus Conduct." Be and the same is hereby amended to read as follows:
