00111p. <br /> 4441/ <br /> y <br /> Ordinance No. 2857-05 <br /> An Ordinance of the City of Everett updating the City Shoreline <br /> Master Program and Shoreline Use Regulations and Amending the <br /> Everett Comprehensive Plan and Zoning Code by Amending <br /> Ordinance Nos. 2600-02, as Amended, Ordinance 2021-94, as <br /> Amended, and Ordinance No. 1671-89, as Amended. <br /> WHEREAS, the Federal Emergency Management Agency in the United States Department of <br /> Homeland Security requires the City to correct and update portions of its floodplain management <br /> program and regulations to maintain the City's eligibility for the National Flood Insurance <br /> Program and to bring the City's plans and codes into conformity with federal requirements; and <br /> WHEREAS, the Washington State Department of Ecology also requires corrections and updates <br /> to the City's floodplain management regulations to bring the City's plans and code into <br /> conformity with state requirements; and <br /> WHEREAS, in order to make the required updates and corrections and to comply with the <br /> Growth Management Act (GMA) requirements for consistency among the City Comprehensive <br /> Plan Elements and development regulations, the City has proposed updates to the City <br /> Floodplain Management Overlay Districts and Regulations (EMC 19.30) and corresponding <br /> portions of the City's Land Use Code, Shoreline Master Program and Comprehensive Plan; and <br /> WHEREAS, the updates to the City's Comprehensive Plan necessitated by the updates to the <br /> floodplain management program and regulations were approved by the City Council on July 20, <br /> 2005; and <br /> WHEREAS, this ordinance will update the City's Shoreline Master Program and shoreline use <br /> regulations to incorporate them and make them consistent with the updates to the City's <br /> Comprehensive Plan and with updates to the City's floodplain management program and <br /> regulations adopted under companion Ordinance Nosea_45, and <br /> WHEREAS, the City has provided notice of the proposed updates to interested members of the <br /> public and to the relevant state agencies, has prepared an environmental checklist, and has issued <br /> a determination of non-significance for the proposed updates under the State Environmental <br /> Policy Act; and <br /> WHEREAS, the Planning Commission has conducted a public hearing on the proposed updates <br /> and has recommended City Council approval of the proposed updates; and <br /> 1 <br />
