ORDINANCE NO. 2859-05 <br /> AN ORDINANCE Amending the Shoreline Master Program by Amending Exhibit A to <br /> Ordinance No. 2600-02, and Amending the Comprehensive Plan and Zoning Code by Amending <br /> Exhibit A to Ordinance No. 2021-94, as Amended (GMA Comprehensive Plan) <br /> and Exhibit A to Ordinance No. 1671-89, as Amended (Zoning Code) <br /> WHEREAS, the City of Everett and the Washington State Department of Ecology approved an <br /> updated Shoreline Master Program for the City of Everett which became effective in May 2002; <br /> and <br /> WHEREAS, the SMP was appealed to the Central Puget Sound Growth Hearings Board and the <br /> Board's Decision was appealed to the Court of Appeals; and <br /> WHEREAS, in December 2004, the City signed a settlement agreement with Washington <br /> Environmental Council, Everett Shoreline Coalition, the Department of Ecology, and the Port of <br /> Everett and the agreement requires amendments to the SMP; and <br /> WHEREAS, the proposed amendments were reviewed under the State Environmental Policy <br /> Act and a Determination of Nonsignificance was issued for the amendments; and <br /> WHEREAS, the Growth Management Act requires local governments to update their <br /> comprehensive.plans and development regulations on a regular basis; and <br /> WHEREAS, the City of Everett on August 3, 1994 adopted the Everett Growth Management <br /> Comprehensive Plan and in July, 2005 adopted the 10-Year Update as required by the Growth <br /> Management Act; and <br /> WHEREAS, the Growth Management Act, RCW 36.70A.130, provides that the goals and <br /> policies of the shoreline master program shall be considered an element of the City's <br /> comprehensive plan, and the other portions of the shoreline master program shall be considered <br /> part of the City's development regulations; and <br /> WHEREAS, the Growth Management Act, RCW 36.70A.130, authorizes the City to amend the <br /> comprehensive plan in order to adopt or amend shoreline master programs at any time; and <br /> WHEREAS, RCW 36.70A.172 requires that jurisdictions include best available science in <br /> developing policies and development regulations to protect the functions and values of critical <br /> 1 <br />
