• <br /> vigil° <br /> ORDINANCE NO. 2863-05 <br /> AN ORDINANCE annexing property located <br /> north of 132 mi Street SE, and south of Silver Lake along 19th Avenue SE known <br /> as the Murphy's Corner Annexation. <br /> WHEREAS;pursuant to RCW 35.13.130, a petition was presented to the City Council <br /> proposing the annexation of certain property; and <br /> WHEREAS, the petition which was filed pursuant to RCW 35.13.130, was signed by <br /> owners of more than seventy-five percent of the total assessed valuation of the property <br /> proposed to be annexed; and <br /> WHEREAS,the seventy-five percent petition was found to meet the requirements of RCW <br /> 35.13.130 and was certified by the Snohomish County Auditors Office on November 4, <br /> 1999, and <br /> WHEREAS, the City Council did conduct a public hearing on December 15, 1999, on the <br /> annexation after the seventy-five percent petition was certified, and <br /> WHEREAS, the City Council approved Resolution No. 4848 approving the submittal of the <br /> annexation of all the property described within the seventy-five percent petition map; and <br /> WHEREAS, the Snohomish County Boundary Review Board approved the annexation on <br /> July 19, 2000, following a public hearing on the proposal, and <br /> WHEREAS, in the case of Snohomish County Fire District No. 1 v. the Washington State <br /> Boundary Review Board for Snohomish County, No. 00-2-06041-4, the Snohomish County <br /> Superior Court ruled against a legal challenge of the Snohomish County Boundary Review <br /> Board's approval of the annexation on November 1, 2001, and <br /> WHEREAS, in an opinion on the appeal of Judge Thibodeau's Superior Court ruling 2004 <br /> (121 Wn. App. 73), the Washington State Court of Appeals ruled in favor of the annexation <br /> upholding the previous decisions of the Boundary Review Board on April 8, 2004 , and <br /> 1 <br />
