/%/111P' <br /> ORDINANCE NO. 3356-13 <br /> AN ORDINANCE Related the Regulations of Signs, <br /> Amending Section 4 of Ordinance No. 2076-95 (EMC <br /> 19.36.220). <br /> Whereas, the regulation of signs (Chapter 19.36 EMC) is a part of the <br /> Zoning Code and should be enforceable pursuant to Chapter 1.20 EMC (code <br /> enforcement procedures) similar to other Zoning Code provisions; and <br /> Whereas, the current provisions for the enforcement of sign regulations <br /> provide useful tools for summary abatement of signs on City right-of-way, but <br /> they do not provide a mechanism for penalizing persons failing, even after notice <br /> by the City, to comply with the City's sign regulations; and <br /> Whereas, Chapter 1.20 EMC provides a process where an alleged <br /> violator of certain City codes is heard before the City's Violation Hearing <br /> Examiner and may be subject to monetary penalties if found to have violated City <br /> codes; and <br /> Whereas, City Council finds that supplementing the enforcement <br /> procedures for sign regulations by authorizing the City to enforce under Chapter <br /> 1.20 EMC will provide an appropriate remedy to those refusing to comply with <br /> City sign regulations; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Section 4 of Ordinance No. 2076-95 (EMC 19.36.220), which reads <br /> as follows: <br /> Sign enforcement. For any sign that violates any provision of this chapter, in lieu <br /> of the enforcement provisions set forth in Chapter 1.20, the city shall utilize the <br /> following enforcement provisions which include removal of the sign and/or <br /> imposition of a penalty: <br /> A. Removal. <br /> 1. Signs located on public or private property that create an immediate threat <br /> to the safety of the public may be summarily removed by the city's code <br /> compliance officer or his/her designee; or <br />
