/1(41%b /=.1 <br /> RESOLUTION No. 5691 <br /> A RESOLUTION APPOINTING AN AUTHORIZED REPRESENTATIVE TO APPLY <br /> FOR FEDERAL PRESCRIPTION DRUG SUBSIDIES <br /> WHEREAS, the City of Everett sponsors and maintains a group health program (hereinafter <br /> referred to as the"Plan"), under which eligible individuals are able to obtain certain prescription <br /> drug benefits; and <br /> WHEREAS, the new Retiree Drug Subsidy program(the"Drug Subsidy Program"), created <br /> pursuant to the Medicare Modernization Act of 2003 and administered by the Center for <br /> Medicare and Medicaid Services (CMS),provides opportunities for plan sponsors to apply for <br /> and receive federal subsidies in respect of prescription drug benefits provided under qualifying <br /> group health plan(s) for plan years beginning on or after January 1, 2006; and <br /> WHEREAS,the City of Everett has retained the services of Part D Advisors, Inc. ("PDA")to <br /> assist the City of Everett in the preparation and submission to CMS of an application for <br /> subsidies available under the Drug Subsidies Program (the"Subsidy Application"), a copy of <br /> which is attached hereto as Exhibit A; and <br /> WHEREAS,the Subsidy Application requires an"Authorized Representative"of the City of <br /> Everett to execute the Subsidy Application on behalf of the City of Everett and thereby bind the <br /> City of Everett to the terms and conditions for obtaining the subsidy payment(s) under the Drug <br /> Subsidy Program; and <br /> WHEREAS,the Council desires to appoint and empower an individual with the legal authority <br /> to act on behalf of the City of Everett as its "Authorized Representative"for purposes of the <br /> Subsidy Application. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> EVERETT that: <br /> the Council of City of Everett does hereby appoint, approve, and empower the Chief Financial <br /> Officer of the City of Everett to act in the name of and on behalf of the City of Everett as its <br /> "Authorized Representative"for purposes of the Subsidy Application,until further action of the <br /> Council of City of Everett; <br />
