OPOb%/ZN:Aa RESOLUTION NO. 5238 A RESOLUTION for the proposed vacation of the alley in Block 623, Plat of Everett, lying North of California Street, South of Everett Avenue, East of Rucker Avenue, and West of Hoyt Avenue WHEREAS, R.C.W. 35.79.010 provides that a right of way vacation may be initiated by a petition of the property owners abutting said right of way, or by a resolution of the legislative authority of the City; and WHEREAS, the owners of the non-City owned property in Block 623 have submitted a petition to vacate that portion of the alley abutting their property, and WHEREAS, the alley abutting the City owned property in Block 623, the Everett Library, Main Branch, was not vacated during the remodel/expansion process, and should now be vacated, and WHEREAS, the City Council has determined that the following described right of way: BEGINNING at the Northeast corner of Lot 1, Block 623, Plat of Everett, according to the plat thereof, recorded in Volume 3 of Plats, Page 32, records of Snohomish County, Washington; THENCE, East along the Easterly projected North line of said Lot 1 to the Northwest corner of Lot 32, of said block; THENCE, South along the Westerly lot lines of Lot 32 descending to the Southwest corner of Lot 17 of said block; THENCE, West along the Westerly projected South line of said Lot 17 to the Southeast corner of Lot 16; THENCE, North along the Easterly lot lines of Lot 16 descending to the Northeast corner of Lot 1, and the POINT OF BEGINNING. and shown on the attached sketch, be considered for vacation in accordance with R.C.W. 35.79.010; and WHEREAS, R.C.W. 35.79.010 further provides that the City Council shall, by resolution, fix a date for public hearing on the consideration of said right of way vacation; and WHEREAS, R.C.W. 35.79.020 provides, in part, that in addition to posting written notice in three (3) of the most public places in the city, and a like notice in a conspicuous place on the right of way to be vacated at least twenty (20) days prior to the date fixed for the hearing, a similar notice be mailed to the owners, or reputed owners, of abutting properties, as shown on the rolls of the county treasurer, at least fifteen (15) days prior to the date fixed for the hearing FORMS:'('('AMSTR(3/31/112 7.45 AM)
