CITY <br /> LICENSE TO USE CITY PROPERTY <br /> Grantor: City of Everett <br /> Grantee: INTERWEST CONSTRUCTION,INC. <br /> Property: See attached Exhibit A <br /> INTERWEST CONSTRUCTION, INC., whose address is: 609 N. Hill Blvd., Burlington, <br /> WA 98223, hereinafter referred to as"INTERWEST", desires to utilize City owned <br /> property for the purpose hereinafter set forth; and <br /> The City is willing to grant INTERWEST authority to use a portion of City's property <br /> upon certain terms and conditions; <br /> NOW,THEREFORE, in consideration of mutual benefits,the promises contained <br /> herein, and other good and valuable consideration,the receipt and sufficiency of which is <br /> hereby expressly acknowledged,the City licenses INTERWEST to use City's property <br /> upon the following terms and conditions: <br /> 1. LICENSED PROPERTY. The specific area of City owned property subject to this <br /> License is described in Exhibit A, hereinafter the ("Property"). <br /> 2. TERM. This License shall be for a period of approximately 10-days beginning at <br /> 8:00 AM on January 17, 2017, and shall expire at 4:00 PM on January 27, 2017. <br /> 3. AUTHORIZED USE. INTERWEST may only use the Property for the purpose of <br /> access in order to load and haul away dredge spoils material that is located on the City's <br /> Property for use at the Port of Everett's Fisherman's Harbor Development Project. <br /> INTERWEST shall coordinate its schedule and activities with other contractors that are <br /> licensed to use City's Property in order to minimize interference and conflict. <br /> 4. Intentionally Omitted. <br /> 5. INDEMNIFICATION. INTERWEST hereby agrees to defend, indemnify and hold <br /> the City harmless from any and Claims for injury to people or damage to property arising <br /> out of or related to this License. "City"means the City, its officers, employees and <br /> agents. "Claims"means any loss, injury, demand, settlement and lawsuit, and further <br /> includes any and all reasonable litigation costs such as attorney's fees, expert fees and <br /> costs, and court costs.
