,4/%5=1Am <br /> RESOLUTION NO. 4 7 5 9 <br /> A RESOLUTION for waiving the public bidding requirement for <br /> the sole source purchase from Sound Eco Systems,Inc. of BYO- <br /> GON PX-109®(a patented biochemical treatment product)for <br /> reducing odor generation from Everett's wastewater collection <br /> system and WPCF aeration ponds. <br /> WHEREAS, public works staff regularly evaluate prevention and control methods for sewer odors from the <br /> Everett collections system and Water Pollution Control Facility aeration ponds on Smith Island. <br /> WHEREAS, Utilities' staff have successfully pilot tested BYO-GON PX-109® in both the WPCF aeration <br /> ponds(1995)and collection system (1998); and <br /> WHEREAS, BYO-GON PX-109®, sold solely by Sound Eco Systems,Inc.,has been credited for odor <br /> reductions and improved treatment system efficiency in several applications around the United States; and <br /> WHEREAS,Utilities' staff have concluded that the aerated pond system is the treatment process for which <br /> odor generation is the most difficult to control due to its large size, shallow depth, and open-air nature; and <br /> WHEREAS, funds are budgeted for such odor control work by the Utilities Division; and <br /> WHEREAS,BYO-GON PX-109®, (a unique alkaloid biostimulant), is sold in Washington State solely by <br /> Sound Eco Systems, Inc.,protected by three(3)U.S. Patents; and <br /> WHEREAS,BYO-GON PX-109® is available only from the dealer, Sound Eco Systems,Inc., <br /> WHEREAS, BYO-GON PX-109 is the only product tested by the City of Everett through a pilot study that <br /> currently meets the City of Everett's odor reduction requirements; <br /> NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> EVERETT that: <br /> the purchase of BYO-GON PX-109 is clearly and legitimately limited to a single source, Sound Eco <br /> Systems, Inc., and that the Purchasing Department is authorized to negotiate and purchase product for a <br /> full-scale treatment program during 1999.
