t <br /> ,I1W <br /> ORDINANCE NO. 2262-97 <br /> AN ORDINANCE providing for the vacation of a portion of <br /> Upper Ridge Road, and an unnamed right of way, known as the <br /> Haul Road, which bisect property owned by CSR Asssociated, <br /> formerly Associated Sand and Gravel, Inc. <br /> WHEREAS, the City Council of the City of Everett did, by Resolution No. 1775, duly <br /> adopt and fix the 7th day of May, 1980, at 8:30A.M., as the date of public hearing; and <br /> WHEREAS, said public hearing was continued until May 21, 1980, and then again until <br /> March 18, 1981; and <br /> WHEREAS, due and legal notice of the time and place of said hearing and determination <br /> of said Resolution has been given by the City Clerk in the manner prescribed by law; and <br /> WHEREAS, at the time and place fixed for hearing, the issues were publicly presented; <br /> and <br /> WHEREAS, after receiving considerable testimony at the May 7 and 21, 1980 public <br /> hearings City Council authorized the Mayor to appoint an Ad Hoc Committee to review the <br /> vacation, and any and all alternate realignments of a Glenwood Avenue/Hardeson Road Arterial <br /> Connection, and to report its findings back to City Council; and <br /> WHEREAS, following said committee report the City of Everett entered into an <br /> agreement with Associated Sand and Gravel, Inc. whereby the rights of way currently bisecting <br /> "Associated's" property would be vacated in exchange for "Associated" dedicating new right of <br /> way, designing, and constructing (to City specifications) a Glenwood Avenue/Hardeson Road <br /> Arterial (Sievers-Duecy Boulevard); and <br /> WHEREAS, Ordinance No. 847-82 vacated a portion of Upper Ridge Road as a <br /> condition of Phase I construction; and <br /> WHEREAS, the agreement between "Associated" and the "City" requires that the <br /> remainder of Upper Ridge Road, and the unnamed right of way, known as Haul Road be vacated <br /> upon completion and acceptance of the Glenwood Avenue/Hardeson Road Arterial; and <br /> WHEREAS, construction is complete, and has been accepted by the City of Everett, and <br /> the right of way for said street has been dedicated, and the deed has been recorded under <br /> Auditors File No. 9109300128 in accordance with the terms of the agreement; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 3 <br />
