#1.•./Zy,r141 <br /> ORDINANCE NO. 2252-97 <br /> AN ORDINANCE ELIMINATING THE GAMBLING TAX SURCHARGE IMPOSED FOR CIP <br /> 1 AND REPEALING ORDINANCE No. 1419-87 (EMC 3.36.050) <br /> WHEREAS, the Everett City Council established Capital Improvements Program <br /> Number 1 by adopting Ordinance No. 1420-87 which provided for a $30 million capital <br /> improvements program; and <br /> WHEREAS, the funding for CIP I projects was designated to come from certain taxes as <br /> described in Ordinance No. 1420-87 to include an additional B&O tax, an additional <br /> Utility tax and an additional Gambling tax; and <br /> WHEREAS, these taxes were to be imposed through 2003 to provide sufficient funds to <br /> accomplish the capital improvements; and <br /> WHEREAS, favorable economic and construction management of the projects will <br /> enable the City to repeal these additional taxes earlier than anticipated; and <br /> WHEREAS, Ordinance Numbers 1960-93 (Section 5), 1419-87 and 1418-87 specifically <br /> inacted these additional taxes; and <br /> WHEREAS, the repeal of Ordinance No. 1419-87 imposing the surcharge on gambling <br /> tax would result in a reduction in the gambling tax on punch boards and pull tabs <br /> reestablishing the tax on punch boards and pull tabs in an amount of four percent of the <br /> gross revenue received as established by Ordinance No 1301-86; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Ordinance No. 1419-87 (EMC 3.36.050) is repealed in its entirety. <br /> Section 2: This ordinance shall take effect January 1, 1998. <br /> Section 3: Nothing contained herein shall be construed as abating any action now <br /> pending under or by virtue of the ordinance herein repealed; or as <br /> discontinuing, abating, modifying or altering any tax liability or any tax <br /> owing or assessed under or by virtue of the ordinance herein repealed; or <br /> as discontinuing, abating, modifying or altering any penalty accrued or to <br /> accrue; or as affecting the right or liability of any person, firm or <br /> corporation, or as waiving any ri.ht of the City under any City ordinance or <br /> provision thereof in force at ime of passage of this ordinance. <br /> 1411 ' <br /> Edw- : I :r en, Mayor <br /> Ac-?1-TZT:frit jel, A <br /> , /9/(6,i, <br /> City Clerk <br /> Passed: 11/26/97 <br /> Valid: 12/03/97 <br /> Effective: 01/01/98 <br /> Published: 12/12/97 <br /> ...J <br />
