. <br /> • <br /> • <br /> 041111bi <br /> . y <br /> ORDINANCE NO. 2249-97 <br /> An Ordinance Amending Ordinance No. 2025-94, as Amended, <br /> Providing for the Annexation of Certain Property <br /> Located in the Lake Chaplain Watershed Area as <br /> a Municipal Purpose Annexation <br /> WHEREAS, the City of Everett annexed 1,920 plus acres of the Lake Chaplain watershed in <br /> 1982 with Ordinance No. 843-82, under the provisions of the State's municipal purpose <br /> annexation statute, RCW 35.13.180; and <br /> WHEREAS, in an effort to expand the City's Lake Chaplain watershed area, a second <br /> annexation adding another 1,180 plus acres of land to the Lake Chaplain watershed was carried <br /> out in 1994 through the adoption of Ordinance No. 2025-94; and <br /> WHEREAS, the City of Everett owns and manages the Lake Chaplain watershed property in the <br /> Sultan River basin for the purpose of providing a municipal water supply for the City of Everett <br /> and other areas in Snohomish County; and <br /> WHEREAS, Section 4 of Ordinance No. 2025-94 assigned a zoning classification to the <br /> property annexed of R-S (Suburban Residential) which was intended to be a holding zone <br /> pending the designation of a more appropriate zoning classification; and <br /> WHEREAS, the City has established a new zone classification and rezoned the Lake Chaplain <br /> area as the Watershed Resource Management Zone (WRM) to express the intended use and <br /> purpose for the area as a municipal watershed thereby removing the holding zone classification <br /> of R-S; <br /> Now, Therefore, The City of Everett Does Ordain: <br /> Section 1. Ordinance No. 2025-94, is amended by the addition of the following: <br /> Section 7: Municipal Purpose Annexation <br /> The Everett City Council concludes that the annexation of the property <br /> described herein is necessary for the protection of the City's water <br /> supply and, consequently, this is a municipal purpose annexation <br /> pursuant to RCW 35.18.180. <br />
