• <br /> #:/%ca- <br /> rT <br /> ORDINANCE NO. 2246-97 <br /> AN ORDINANCE providing for the vacation of Lombard Avenue north of Tenth Street <br /> and south of Tower Street; Ninth Street east of Lombard Avenue and west of the alley between <br /> Lombard and Broadway, and the alley north of Tenth Street and south of Tower Street which is <br /> between Broadway and Lombard Avenue. <br /> WHEREAS, the City Council of the City of Everett, did by Resolution No. 4470 duly <br /> adopt and fix the 27th day of August, 1997 at 8:30A.M., as the date of public hearing; and <br /> WHEREAS, due and legal notice of the time and place of said hearing and determination <br /> of said Resolution has been given by the City Clerk in the manner prescribed by law; and <br /> WHEREAS, at the time and place fixed for hearing, the issues were publicly presented; <br /> and <br /> WHEREAS, the City Council finds it would not vacate said rights of way could it not <br /> retain easements for utilities in Lombard Avenue to be vacated; and <br /> WHEREAS, it now appears to the City Council of the City of Everett that the said rights <br /> of way resolved to be vacated should be vacated pursuant to the terms and conditions of this <br /> ordinance: <br /> NOW, THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: <br /> That the following described rights-of-way: <br /> All that portion of Lombard Avenue,described as follows: <br /> BEGINNING at the Northeast corner of Lot 24, Block 164, Plat of Swalwell's Fourth Addition, <br /> according to the plat thereof, recorded in Volume 7 of Plats, Page 44, records of Snohomish County, <br /> Washington; THENCE, East along the Easterly projected North line of said Lot 24 to the Northwest <br /> corner of Lot 11,Block 163 of said Plat of Swalwell's Fourth Addition; THENCE, South along the West <br /> line of said Lot 11, and the Southerly projection thereof,to the Southwest corner of Lot 17, Block 180, <br /> Plat of Bailey's Addition, according to the plat thereof,recorded in Volume 9 of Plats, Page 78, records <br /> of Snohomish County, Washington; THENCE, West along the Westerly projection of the South line of <br /> said Lot 17 to the Southeast corner of Lot 18, Block 179, of said Plat of Bailey's Addition; THENCE, <br /> North along the East line of said Lot 18, and the Northerly projection thereof, to the Northeast corner of <br /> Lot 24,Block 164,Plat of Swalwell's Fourth Addition,and the POINT OF BEGINNING;and <br />
