• <br /> • <br /> • <br /> /** <br /> 1811%//:-..A.agai <br /> ORDINANCE NO.aa58-97 <br /> AN ORDINANCE relating to drug-free zones, amending Section 1 of Ordinance No. <br /> 1775-91 (Section 10.35.100 EMC). <br /> WHEREAS, the state legislature has amended RCW 69.50.435 to include public housing <br /> developments within the list of areas eligible for designation as a drug-free zone; and <br /> WHEREAS, the amendment to RCW 69.50.435 will become effective July 27, 1997; and <br /> WHEREAS, the state legislature has found that a large number of illegal drug <br /> transactions occur in or near public housing projects; and <br /> WHEREAS, the state legislature has found that this activity places the families and <br /> children residing in these housing projects at risk for drug-related crimes and increases <br /> the general level of fear among the residents of the housing project and the areas <br /> surrounding these projects; and <br /> WHEREAS, the intent of the legislature is to allow local governments to designate public <br /> housing projects as drug-free zones; and <br /> WHEREAS the Everett Housing Authority's public housing residents have actively <br /> supported the revision to the statute and support the designation of the Everett Housing <br /> Authority's developments as drug-free zones; and <br /> WHEREAS, on May 27, 1997 the Everett Housing Authority Commissioners adopted <br /> Resolution No. 800 requesting the City of Everett adopt an ordinance designating public <br /> housing projects as drug-free zones, listing six (6) public housing projects as eligible for <br /> designation as drug-free zones; <br /> NOW, THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Ordinance No. 1775-91, Section 1, (EMC 10.35.100) which currently reads as <br /> follows: <br /> Drug-free zones-Violations. <br /> A. Any person who violates Section 10.35.020 by using or possessing <br /> drug paraphernalia, or who violates Section 10.35.030 by delivering, <br /> 1 <br />
