ORDINANCE NO. 2 2 0 5-9 7 <br /> An Ordinance Amending Section 5 of Ordinance#1671-89, as Amended, the City of Everett <br /> Zoning Code,the A-1 (Agricultural)Zone, and Amending Section 30.030.A of Ordinance <br /> #1671-89, as Amended, the Rural Floodway District(RFD) and Rural Flood Fringe District <br /> (RFFD)to Clarify that"Ball Fields" and Similar Recreational Uses Are Included <br /> in the Category of Permitted Uses Entitled"Public Outdoor Recreation Uses." <br /> WHEREAS,the City of Everett adopted Ordinance#1671-89 establishing a new Zoning Code <br /> which became effective January 13, 1990; and <br /> WHEREAS,the Zoning Code includes an Agricultural (A-1)Zone District which allows "Public <br /> Outdoor Recreation Uses" as a permitted use; and <br /> WHEREAS,the Zoning Code includes Rural Floodway (RFD) and Flood Fringe (RFFD) <br /> Overlay Zone Districts which list a number of public and recreational uses as permitted uses, <br /> including: municipal facilities, golf courses,tennis courts, archery ranges,target ranges,trap and <br /> skeet ranges,picnic grounds, and driving ranges; and <br /> WHEREAS, the City is proposing to acquire land in the A-1RFD zone for the express purpose of <br /> developing public recreational soccer and softball/baseball fields; and <br /> WHEREAS, the City wants to clarify that"ball fields" are expressly listed as permitted uses in <br /> the A-1 Zone and in the RFD and RFFD Overlay Zones; and <br /> WHEREAS,the Planning Commission held a public hearing on January 7, 1997 to consider the <br /> proposed amendments to the Zoning Code and has recommended that the City Council amend <br /> the A-1 zone, and the RFD and RFFD Overlay zone regulations for the purpose stated above; and <br /> WHEREAS, the City Council finds: <br /> 1. The proposed amendments to the Zoning Code are consistent with Everett <br /> Comprehensive Plan policies for Open Space, Agricultural Land Use, and with the <br /> Capital Facilities Element 6 Year capital expenditure plan; and <br /> 2. The proposed amendments to the Zoning Code bear a substantial relation the public <br /> health, safety and welfare; and <br /> 3. The proposed amendments to the Zoning Code promote the best long term interests of the <br /> Everett community. <br /> Now, therefore, the City of Everett does ordain: <br />
