• <br /> • <br /> ORDINANCE NO. 2203-{97 <br /> An Ordinance Amending and Finalizing the Emergency Measure of the <br /> City of Everett Comprehensive Plan Related to Adult Use Businesses and Making the Policies <br /> Permanent, Amending Ordinance No. 2143-96, Repealing Section 6 of Ordinance No. 2143-96, <br /> and Repealing Sections 1 and 2 of Ordinance No. 2177-96. <br /> WHEREAS, the City of Everett adopted a new Comprehensive Plan in August, 1994, in <br /> conformance with the Washington State Growth Management Act; and <br /> WHEREAS,the Growth Management Act, codified as RCW Chapter 36.70A, allows for <br /> comprehensive plans to be amended whenever an emergency exists; and <br /> WHEREAS, the City Council, following public hearings before the Planning Commission and <br /> City Council, adopted on an emergency basis Comprehensive Plan policies for adult use <br /> businesses on May 8, 1996 for a six-month period; and <br /> WHEREAS, the City Council, following public hearings before the Planning Commission and <br /> City Council, extended the Comprehensive Plan policies for adult use businesses an additional <br /> six months to allow for the City to review technical issues raised before the Growth Hearings <br /> Board, and to allow for additional public participation in the development of final comprehensive <br /> plan policies for adult use businesses; and <br /> WHEREAS, an environmental analysis of the proposed Comprehensive Plan amendments has <br /> been conducted by the City in compliance with the requirements of the State Environmental <br /> Policy Act(SEPA); and <br /> WHEREAS,the City of Everett has encouraged public participation in the consideration of <br /> Amendments to the Comprehensive Plan, as required by the Growth Management Act, through a <br /> variety of notification procedures, including SEPA review, mailing to interested citizens and <br /> organizations, legal publication, and the City of Everett cable television bulletin board, public <br /> workshops and public hearings; and <br /> WHEREAS,the Planning Commission conducted a public workshop on December 17, 1996 and <br /> a public hearing on January 21, 1997,to consider the proposed amendments to the Land Use <br /> Element policies of the Comprehensive Plan related to adult use businesses, and has made <br /> recommendations to the City Council; and <br /> WHEREAS,the concurrence of the Adult Use Business policy amendment process and the <br /> Annual Update to the Comprehensive Plan has enabled the City Council to consider the proposed <br /> policy amendments for adult use businesses together with all of the proposed annual <br /> Comprehensive Plan Land Use Map and Policy amendments and implementing rezones, so that <br /> the cumulative effects of all amendments have been fully ascertained; and <br /> 1 <br />
