• <br /> ORDINANCE NO. a/4p0 -9ep <br /> AN ORDINANCE relating to obstructing governmental operation, amending <br /> section 81 of Ordinance No. 1145-85 (Everett Municipal Code (EMC) <br /> 10.12.180), and adding a new section to Ordinance No. 1145-85 (EMC Title 10 - <br /> Criminal Code). <br /> WHEREAS, the Washington State Legislature has made certain changes in the definition <br /> and penalties regarding Obstructing Law Enforcement Officers and the making of false or <br /> misleading statements to public officials; and <br /> WHEREAS, the City Council of the City of Everett finds it desirable to be consistent with <br /> state law in regards to Obstructing Law Enforcement Officers and the making of false or <br /> misleading statements to public officials; and <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 81 of Ordinance No. 1145-85 (EMC 10.12.180), which reads as <br /> follows: <br /> Obstructing peace officer. <br /> A. A person commits the offense of obstructing a peace officer if <br /> 1. He or she knowingly hinders, delays, or obstructs a peace officer in the discharge <br /> of his or her official powers or duties; or <br /> 2. He or she makes any wilfully untrue, misleading or exaggerated statement to a <br /> peace officer in the discharge of his or her official powers or duties. <br /> B. Obstructing a peace officer is a misdemeanor. <br /> is hereby amended to read as follows: <br /> Obstructing a law enforcement officer. <br /> A. A person is guilty of obstructing a law enforcement officer if the person willfully <br /> hinders, delays, or obstructs any law enforcement officer in the discharge of his or <br /> her official powers or duties. <br /> B. "Law enforcement officer" means any general authority, limited authority, or <br /> specially commissioned Washington peace officer or federal peace officer as those <br /> terms are defined in RCW 10.93.020 as now or hereafter amended, and other public <br /> officers who are responsible for enforcement of fire, building, zoning, and life and <br /> safety codes. <br /> C. Obstructing a law enforcement officer is a gross misdemeanor. <br />
