ORDINANCE NO. 0745-3.-96, <br /> AN ORDINANCE relating to certain penalty provisions of the Everett Criminal Code, <br /> amending section 47 of Ordinance 1145-85 (EMC 10.68.040 - Criminal Trespass - Second <br /> Degree) and section 61 of Ordinance 1145-85 (EMC 10.48.010 - Disorderly Conduct). <br /> WHEREAS, the enforcement and punishment of criminal activity in the City of Everett is a <br /> high priority: and <br /> WHEREAS, the City of Everett City Council finds it appropriate to provide penalties in <br /> conformity with state law. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 47 of Ordinance 1145-85 (EMC 10.68.040 - Criminal Trespass - <br /> Second Degree), which reads as follows: <br /> A. A person is guilty of criminal trespass in the second degree if he knowingly <br /> enters or remains unlawfully in or upon premises of another under circumstances not <br /> constituting criminal trespass in the first degree. <br /> B. Criminal trespass in the second degree is a misdemeanor and may be <br /> punished by a fine not to exceed one thousand dollars. <br /> is hereby amended to read as follows: <br /> A. A person is guilty of criminal trespass in the second degree if he knowingly <br /> enters or remains unlawfully in or upon premises of another under circumstances not <br /> constituting criminal trespass in the first degree. <br /> B. Criminal trespass in the second degree is a misdemeanor. <br /> Section 2: Section 61 of Ordinance 1145-85 (EMC 10.48.010 - Disorderly Conduct), <br /> which reads as follows: <br /> A. A person is guilty of disorderly conduct if he or she: <br /> 1. Uses abusive or obscene language and thereby intentionally creates a risk <br /> of assault; or <br /> 2. Intentionally and unreasonably disrupts any lawful assembly or meeting of <br /> persons and refuses or intentionally fails to cease such activity when ordered to do so <br /> by the person in charge to the assembly or meeting; or <br /> 3. Intentionally obstructs vehicular or pedestrian traffic without lawful <br /> authority and refuses or intentionally fails to cease such activity when ordered to do <br /> so by a peace officer; or <br />
