• <br /> ORDINANCE NO. 2156-96 <br /> AN ORDINANCE providing for the vacation of a portion of the west side of West Marine View Drive <br /> lying north of 18th Street. <br /> WHEREAS, the City Council of the City of Everett, did by Resolution of Intention to Vacate (Resolution <br /> No. 4259) duly adopt and fix the 22nd day of May 1996, at 8:30 A.M., as the date of public hearing; and <br /> WHEREAS, due and legal notice of the time and place of said hearing and determination of said <br /> Resolution has been given by the City Clerk in the manner prescribed by law; and <br /> WHEREAS, at the time and place fixed for hearing, the issues regarding the proposed vacation were heard <br /> and discussed; and <br /> WHEREAS, at the time and place fixed for hearing, a redefined vacation boundary reflecting a smaller <br /> proposed vacation area was described by legal description shown on the attached EXHIBIT "A"; and <br /> WHEREAS, the City Council finds it would not vacate the portion of the West Marine View Drive <br /> proposed for vacation could it not retain an easement; and <br /> WHEREAS, it now appears to the City Council of the City of Everett that the said redefined portion of <br /> West Marine View Drive resolved to be vacated should be vacated pursuant to the terms and conditions of this <br /> ordinance: <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: <br /> That the following described right-of-way: <br /> legally shown on the attached EXHIBIT "A" <br /> be and the same is hereby vacated pursuant to the conditions set forth in this ordinance. <br /> Section 2: <br /> That the City of Everett shall not be responsible nor liable for storm drainage runoff resulting from existing <br /> drainage patterns as established on City rights-of-way that may currently, or in the future, go over, under or across <br /> the above described in Section 1 (EXHIBIT "A") herein. <br /> Section 3: <br /> That compensation to the City of Everett for this vacation is accepted as an exchange of property (in accordance <br /> with Resolution No. 3147), being the 8/29/95 conveyance of Port of Everett property to the City of Everett <br /> recorded with the Snohomish County Auditor under #8509280546. Said Port of Everett property was located <br /> adjacent to the west side of West Marine View Drive and was beneficial for the widening of West Marine View <br /> Drive from 10th Street to 18th Street. <br />
