• ORDINANCE NO. 2149-96 EVERETT AN ORDINANCE amending the City's regulations of Public Places of Adult Entertainment, amending Ordinance No. 1196-85, as amended (Chapter 5.120 EMC). WHEREAS, the City of Everett City Council deems it necessary to adopt this ordinance in the interests of public health, safety and welfare; and WHEREAS, based on public testimony and other evidence presented to it, the City Council has determined that the proximity between entertainers and patrons during adult entertainment performances can facilitate sexual contact, prostitution and related crimes; and WHEREAS, concerns about crime and public sexual activity are legitimate and compelling concerns of the City which demand reasonable regulation of public places of adult entertainment in order to protect the public health, safety and general welfare; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: Section 1(B) of Ordinance No. 1196-85, as codified at EMC 5.120.020 which reads as follows: Definitions. For the purpose of this chapter the words and phrases used in this chapter, unless the context otherwise indicates, shall have the following meanings: A. "Adult entertainment" means any exhibition or dance of any type conducted in premises where such exhibition or dance involves the exposure to view of any portion of the breast below the top of the areola or any portion of the pubic hair, anus, buttocks, vulva and/or genitals. B. "Clerk" means the city clerk of the city who is designated by the mayor as licensing official under this chapter. It also includes his/her designee. C. "Employee means any and all persons, including entertainers, who work in or at or render any services directly related to the operation of a public place of adult entertainment which offers, conducts or maintains adult entertainment. D. "Entertainer" means any person who provides adult entertainment within a public place of adult entertainment as defined in this section whether or not a fee is charged or accepted for entertainment. E. "Entertainment" means any exhibition or dance of any type, pantomime, modeling or any other performance. F. "Manager" means any person who manages, directs, administers or is in charge of, the affairs and/or the conduct of any portion of any activity involving adult entertainment occurring at any place offering adult entertainment.
