Ordinance No. ,.-2//41- 9.5- <br /> An <br /> -2//41- 9SAn Ordinance adopting Weights and Measures regulations and <br /> repealing Ordinance No. 4087 (Chapter 9 . 70 EMC) . <br /> WHEREAS, Title 35 RCW grants to cities of the first class the <br /> power to regulate markets and to provide for the weighing, <br /> measuring and inspection of articles offered for sale thereat, <br /> and to enforce the keeping of proper legal weights and measures <br /> by all vendors in such city, and to provide for the inspection <br /> thereof; and <br /> WHEREAS, the City Council of the City of Everett concurs with the <br /> State Legislative finding that the accuracy of weighing and <br /> measuring instruments and devices used in commerce affect every <br /> consumer and is of importance to the public interest. And that <br /> fair weights and measures are equally important to business and <br /> the consumer; and <br /> WHEREAS, the 1995 State Legislature adopted device registration <br /> fees to help offset a portion of weights and measures operating <br /> costs and the legislation required that cities adopt fees equal <br /> to or less than the Statute level or forfeit revenues collected <br /> from device registrations within their jurisdictions; and <br /> WHEREAS, the City Council finds that the registration fees herein <br /> are reasonable and appropriate; and <br /> WHEREAS, the City' s Weights & Measures Ordinance has not been <br /> revised, updated or amended since its inception in 1965, and is <br /> in need of modernization to reflect revisions in State law, to <br /> comply with NIST (U. S. Dept of Commerce) publications and to <br /> reflect current technology and standards; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Short Title. <br /> This chapter may be cited as the "weights and measures ordinance <br /> of Everett. " <br /> Section 2 : Definitions. <br /> As used in this chapter, unless the context clearly indicates <br /> otherwise, the following words shall have the following <br /> respective meanings: <br /> A) - GENERAL <br /> 1) City. The term "City" means the City of Everett <br /> 2) Weight(s) and (or) Measure(s) . The term "weight(s) <br /> and/or measure(s) " mean all weights and measures of every <br /> kind, instruments and devices for weighing and measuring, <br /> 1 <br />
