a* 4 ORDINANCE NO. 2104-95 AN ORDINANCE providing for the vacation of a portion of(unopened) 23rd Ave. SE, North of 100th St. SE. WHEREAS,the City Council of the City of Everett, did by Resolution No. 4113 duly adopt and fix the 13th day of September 1995, at 8:30 A.M., as the date of public hearing; and WHEREAS, due and legal notice of the time and place of said hearing and determination of said Resolution has been given by the City Clerk in the manner prescribed by law; and WHEREAS, at the time and place fixed for hearing,the opportunity for hearing and discussion of favorable statements and objections to the herein described vacation was given; and WHEREAS,the City Council finds it would not vacate the street could it not retain an easement; and WHEREAS, it now appears to the City Council of the City of Everett that the said street resolved to be vacated should be vacated pursuant to the terms and conditions of this ordinance: NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the following described rights-of-way: THAT PORTION OF THE EAST 30 FEET OF THE SOUTHEAST QUARTER OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 17, TOWNSHIP 28 NORTH, RANGE 5 EAST, W.M., IN SNOHOMISH COUNTY, WASHINGTON, MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE SOUTHEAST CORNER OF SAID SOUTHEAST QUARTER; THENCE NORTH 00°24'54" EAST ALONG THE EAST LINE OF SAID SOUTHEAST QUARTER A DISTANCE OF 425.32 FEET TO THE TRUE POINT OF BEGINNING; THENCE CONTINUING NORTH 00°24'54" EAST ALONG SAID EAST LINE A DISTANCE OF 239.31 FEET; THENCE NORTH 88°00'15" WEST PARALLEL WITH THE NORTH LINE OF SAID SOUTHEAST QUARTER A DISTANCE OF 31.01 FEET; THENCE SOUTH 00°24'54" WEST 238.16 FEET TO A POINT ON A CURVE TO THE RIGHT HAVING A RADIUS OF 48.00 FEET; A RADIAL LINE THROUGH SAID POINT BEARS NORTH 14°03'45" WEST; THENCE ALONG THE ARC OF SAID CURVE PASSING THROUGH A CENTRAL ANGLE OF 36°30'07" AN ARC DISTANCE OF 30.58 FEET TO THE TRUE POINT OF BEGINNING. be and the same is hereby vacated pursuant to the conditions set forth in this ordinance. Section 2: That the City of Everett shall not be responsible nor liable for storm drainage runoff resulting from existing drainage patterns as established on City rights-of-way that may currently, or in the future, go over, under or across the above described in Section 1 herein.
