• low ORDINANCE NO. 2101-95 AN ORDINANCE relating to the sale and discharge of common fireworks, amending sections 1 and 3 of Ordinance No. 1792-91 (EMC 16.60.110 & .114), and providing an effective date one year after the adoption of this ordinance, pursuant to RCW 70.77.250(4). WHEREAS, the 1995 Washington State Legislature adopted Substitute Senate Bill 5997 (Chapter 61, 1995 Laws of Washington), allowing the sale and discharge of fireworks on December 31st of each year; and WHEREAS, the City of Everett City Council deems it necessary for the general safety, health and welfare of its citizens to prohibit the sale and discharge of fireworks on December 31st of each year. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section l: Section 1 of Ordinance No. 1792-91 (EMC 16.60.110), which reads as follows: Hours of sale. No common fireworks shall be sold within the city limits of Everett except from twelve noon on the 28th day of June to twelve noon on the 6th of July of each year. No common fireworks may be sold between the hours of eleven p.m. and nine a.m. is hereby amended to read as follows: Hours of sale. No common fireworks shall be sold within the city limits of Everett except from twelve noon on the 28th day of June to twelve noon on the 6th of July of each year. No common fireworks may be sold between the hours of eleven p.m. and nine a.m. No common fireworks shall be sold within the city limits of Everett on the 31st day of December of any year. Section 2: Section 3 of Ordinance No. 1792-91 (EMC 16.60.114), which reads as follows: Hours of discharge. Unless otherwise allowed by permit, no fireworks may be discharged within the city limits of Everett except between the hours of nine a.m. and eleven p.m. on the Fourth of July of each year.
