• <br /> • <br /> ORDINANCE NO D '7 9 <br /> AN ORDINANCE establishing a Downtown Business Improvement Area(BIA); providing <br /> for the levy of a special assessment upon real property (and the owners thereof) within the <br /> area;the deposit of revenues in a special account and expenditures therefrom, and providing <br /> for an implementing agreement with a downtown Everett property owners association, or <br /> similar organization. <br /> WHEREAS, the owners of property subject to the special assessment levied by this <br /> ordinance filed a petition with the City of Everett to establish a Business Improvement Area <br /> pursuant to Chapter 35.87A RCW; and <br /> WHEREAS, the City Council, on August 9, 1995, adopted Resolution No. 4149, initiating <br /> a Downtown Everett Business Improvement Area; and <br /> WHEREAS, the City Council, pursuant to Resolution No. 4151, adopted August 16, 1995, <br /> declared its intent to establish a Downtown Everett Business Improvement Area pursuant to <br /> Chapter 35.87A RCW, and <br /> WHEREAS, as provided in Resolution No. 4151, the City Council held a public hearing on <br /> September 20, 1995 in the Everett City Hall Council Chambers, concerning the formation <br /> of the Downtown Business Improvement Area and the imposition of special assessments on <br /> property (and property owners) within such Business Improvement Area, prior to the <br /> adoption of this ordinance; <br /> NOW, THEREFORE BE IT ORDAINED BY THE CITY OF EVERETT: <br /> Section 1: DISTRICT ESTABLISHED. <br /> As authorized by Chapter 35.87A RCW, there is hereby established a Downtown Everett <br /> Business Improvement Area(BIA) within the following described boundaries (when a street <br /> or alley is named, the District boundary is the center line of the right-of-way unless <br /> otherwise stated): <br /> Beginning at the intersection of the centerline of Pacific Avenue and the centerline of <br /> the alley west of Hoyt Avenue, thence north along the centerline of the alley west of <br /> Hoyt Avenue to the intersection of the center line of Everett Avenue, thence east <br /> along the centerline of Everett Avenue to the intersection of the centerline of the alley <br /> west of Colby Avenue, thence north along the centerline of the alley west of Colby <br /> Avenue to the centerline of 26th Street, thence east along the centerline of 26th Street <br /> to the intersection of the centerline of the alley east of Wetmore Avenue to the <br /> intersection of the centerline of Pacific Avenue, thence west along the centerline of <br /> Pacific Avenue to the point of beginning. <br /> Situated in the City of Everett, County of Snohomish, State of Washington. <br />
