EY ii" ,4407 ORDINANCE NO. 2095-95 An Ordinance Amending the Zoning Code Regulations for Nonconforming Uses and Buildings, amending Section 38.010 of Ordinance No. 1671-89 (EMC 19.38.010), Section 38.020 of Ordinance No. 1671-89 (EMC 19.38.020), Section 38.030 of Ordinance No. 1671-89 (EMC 19.38.030), Section 38.040 of Ordinance No. 1671-89 (EMC 19.38.040), Section 38.050 of Ordinance No. 1671-89 (EMC 19.38.050), Section 38.060 of Ordinance No. 1671-89 (EMC 19.38.060),Section 38.070 of Ordinance No. 1671-89 (EMC 19.38.070), and Section 38.100 of Ordinance No. 1671-89 (EMC 19.38.100) WHEREAS,the City did adopt Ordinance No. 1671-89 establishing a new Zoning Code which became effective on January 13, 1990; and • . WHEREAS, said Ordinance established regulations for nonconforming uses, buildings and lots; and WHEREAS, the City Council finds that the zoning regulations for nonconforming uses and buildings need revision to clarify said regulations; and WHEREAS, the City Council finds that the proposed revisions to the zoning code regulations for nonconforming uses and buildings are consistent with the Everett Comprehensive Plan; bear a substantial relation to the public health, safety and welfare; and promote the,best long-term interests of the Everett Community. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: Section 38.010 of Ordinance#1671-89, as amended (EMC 19.38.010), which reads: Purpose. The purpose of this chapter is to regulate nonconforming buildings, uses or lots. is hereby amended to read: Purpose. The purpose of this chapter is to regulate nonconforming structures, uses and lots. Section 2. Section 38.020 of Ordinance#1671-89(EMC 19.38.020),which reads: Continuation of use of building or property. If an aspect, element or activity of or on the subject property is nonconforming,that aspect, element or activity may continue and need not be brought into conformance with this title unless a specific provision of this title otherwise requires conformance(see the sections of this title concerning nonconforming adult use businesses in Chapter 39 and nonconforming signs in Chapter 36).
