• <br /> • <br /> al,Peinw <br /> ORDINANCE NO. 2 0 5 7—9 5 <br /> AN ORDINANCE relating to panorams, amending section 1 (J) of Ordinance <br /> No. 1197-85, as amended by section 3 of Ordinance No. 1241-86 (Everett <br /> Municipal Code 5.124.100), section 1 (K) of Ordinance No. 1197-85, as <br /> amended by section 4 of Ordinance No. 1241-86 (EMC 5.124.110), amending <br /> section 1 (L) of Ordinance No. 1197-85, as amended by section 1 of Ordinance <br /> No. 1315-86 (EMC 5.124.120). <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 1 (J) of Ordinance No. 1197-85, as amended by section 3 of <br /> Ordinance No. 1241-86 (Everett Municipal Code 5.124.100), which reads as follows: <br /> Issuance of licenses. <br /> A. After an investigation, the clerk shall issue the applicable license or licenses <br /> authorized by this chapter if the clerk finds: <br /> 1. That the applicant complies with all of the requirements of this chapter; and <br /> 2. That the applicant, his or her employee, agent, partner, director, officer, <br /> stockholder or manager has not made any false, misleading or fraudulent statement of fact <br /> in the application for a license, or in any report or record required to be filed with the <br /> clerk. <br /> B. The license application shall be approved or disapproved within ten <br /> working days from the date of filing a completed application which complies with the <br /> requirements of this chapter, unless the applicant agrees to an extension of the time period <br /> in writing. <br /> C. In the event that the city denies a license, the city shall within the aforesaid <br /> ten-day period notify the applicant of the denial and the reasons therefor. The denial shall <br /> be for a period of time not to exceed one year. Should the applicant disagree with the <br /> city's determination, he must file a notice of nonacceptance with the city attorney's office, <br /> within ten working days of receipt of the notification of denial. <br /> D. The city shall, within five working days following receipt of the notice of <br /> nonacceptance, apply to the county court for a judicial determination as to whether the <br /> applicant's license was properly denied. The burden of showing that the applicant's license <br /> was properly denied shall rest on the city. <br /> E. If a preliminary judicial determination sustaining the city's denial of the <br /> subject license is not obtained within five working days from the date the complaint is <br /> served, an interim license shall be issued under this chapter by operation of the law. Such <br /> interim license shall issue in any event if a final judicial determination on the merits is not <br /> obtained within twenty days from the date the complaint is filed. In such case, the interim <br /> license will remain in effect until a final judicial determination on the merits is reached. <br />
