• <br /> • 0111P <br /> ORDINANCE NO. 2051-95 ;;EM:.ATE T <br /> AN ORDINANCE revising the Board of Adjustment and <br /> amending Section 41.140 of Ordinance No. 1671-89 <br /> (EMC 19.41.140). <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION 1: Section 41.140 of Ordinance No. 1671-89 (EMC 19.41.140) reads <br /> as follows: <br /> 41.140 Board of Adjustment Created. <br /> A. Created-Purpose-Membership-Term. A Board of Adjustment is <br /> herewith established. The board shall hear and decide all applications <br /> for variances from the provisions of requirements of this title except as <br /> specified in Subsection 41.130 of this Ordinance. The board shall <br /> consist of five members, all of whom reside in the City of Everett and <br /> shall serve without salary. The board members shall be appointed by <br /> the mayor with consent of the council and shall consist of citizens <br /> having an understanding of the benefits of zoning to the municipality. <br /> In case any vacancy should occur in the membership of the board, for <br /> any cause, the mayor shall fill such vacancy by making an appointment <br /> with the consent of the council. The members of the board may be <br /> removed by the mayor, subject to the approval of the council for such <br /> causes as he shall deem sufficient, which shall be set forth in a letter <br /> filed with the council. Appointments shall expire on December thirty- <br /> first. Commencing with the expiration of the existing terms, each new <br /> appointment shall be for a term of six years. Notwithstanding the <br /> above, the mayor is authorized to make an appointment for a term of <br /> less than six years to ensure that the terms are staggered. <br /> B. Meetings. Meetings of the board shall be held at such times as <br /> the chairman of the board may determine, or upon request of the city <br /> administration. There shall be a fixed place of meetings, and all <br /> regular board meetings shall be open to the public. Notice of all public <br /> hearings before the board shall be given by publication in the city <br /> official newspaper at least ten calendar days prior to the date set for <br /> the hearing. The board shall adopt its own rules of procedure and <br /> keep a record of its proceedings, findings and action in each case, and <br /> the vote of each member on each question considered in the <br />
