411-°11111. <br /> EL JFETT <br /> ORDINANCE NO. 2011-94 <br /> An Ordinance Amending Section 11 of Ordinance No. 1736-90 (EMC 2.20.110), Pertaining to <br /> Planning Commission Recommendations to the City Council on Comprehensive Plan Issues. <br /> WHEREAS, Ordinance No. 1736-90 established the duties and responsibilities of the Planning <br /> Commission; and <br /> WHEREAS, Section 11 of said ordinance pertains to the amendment and adoption of <br /> comprehensive plans and also establishes procedures for the City Council to follow in reviewing <br /> the recommendation of the Planning Commission as it relates to the comprehensive plan; and <br /> WHEREAS, Section 11 of Ordinance No. 1736-90 reduces the ability of the City Council to <br /> make timely and efficient decisions related to the comprehensive plan; and <br /> WHEREAS, the deadlines established by the Growth Management Act require the City Council <br /> to make important decisions regarding Everett's future within a relatively short time period; and <br /> WHEREAS, amending Section 11 of Ordinance No. 1736-90 would enable the City Council to <br /> make decisions related to the comprehensive plan in a more timely and efficient manner; and <br /> WHEREAS, the Planning Commission and City Council find that the amendment of Ordinance <br /> No. 1736-90 would serve the public's best interest in reviewing and adopting the comprehensive <br /> plan. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 11 of Ordinance No. 1736-90 (EMC 2.20.110), which reads: <br /> Comprehensive Plan - Amendment and Adoption. The comprehensive plan, any element thereto, <br /> or any portion thereof may be amended to meet changing conditions. Before approving or <br /> recommending a comprehensive plan or any amendment, element, extension, deletion, or addition <br /> thereto or any official control, the Planning Commission shall conduct at least one public hearing <br /> on the subject. Following the public hearing the Planning Commission may alter, modify, <br /> approve, or disapprove the plan, or any portion, as its judgment dictates. The initial plan, <br /> subsequent elements, extension, addition, or amendments, or official controls, after approval by <br /> the Planning Commission shall be transmitted to the City Council by a written recommendation. <br /> The Planning Commission's recommendations shall be considered by the City Council at a regular <br /> public meeting. If a majority of the Council approves the recommendation as submitted, the <br /> Council shall then formally adopt the recommendation by motion, resolution, or other means <br /> which will render the recommended comprehensive plan, element, addition, extension, <br /> amendment, or official control, the expressed intent and policy of the City. If the <br /> recommendation is disapproved by the Council, the proposal shall be referred back to the <br /> commission for further consideration and adjustment; thereafter, upon re-submission of the <br /> proposal by the Planning Commission, Council may approve, disapprove, or take such final action <br />
