• • • ORDINANCE NO. 2008-94 AN ORDINANCE adopting the Washington Model Traffic Ordinance (MTO) as contained in the Washington Administrative Code, Chapter. 308-330 WAC, to regulate traffic in the City of Everett; amending Chapter. 46.04 of the Everett Municipal Code; adopting and incorporating by reference sections 1, 4, 5, 6, 10 and 11 of chapter 275, Washington Laws of 1994. WHEREAS, it is desirable that the City of Everett be in conformity with State law as it relates to traffic laws; and, WHEREAS, the state legislature has provided that Chapter. 46.90 RCW, which contained the Washington Model Traffic Ordinance, will expire on July 1, 1994; and, WHEREAS, the provisions of the Washington Model Traffic Ordinance have been readopted in the Washington Administrative Code in Chapter. 308-330 WAC, which will become effective on July 1, 1994; and WHEREAS, certain sections of the traffic laws passed by the 1994 Washington State Legislature will not be incorporated into the Model Traffic Ordinance by July 1, 1994. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: SECTION 1: ADOPTION BY REFERENCE. The "Washington Model Traffic Ordinance," Chapter. 308-330 WAC, is hereby adopted by reference as the traffic ordinance of the City of Everett as if set forth in full. SECTION 2: SECTIONS NOT ADOPTED. The following sections of the MTO are not adopted by reference and are expressly deleted; 46.90.260; 46.90.265; 46.90.270; 46.61.565; 46.61.570; 46.61.575; 46.61.600; 46.90.430; 46.90.433; 46.90.436; 46.90.439; 46.90.442; 46.90.445; 46.90.451; 46.90.454; and 46.90.457. SECTION 3: The following sections of Washington state law are hereby adopted by reference in all respects as though such sections were set forth herein in full: Sections 1, 4, 5, 6, 10, and 11 of Chapter 275, 1994 Laws of the State of Washington.
