x§w <br /> 4,01 <br /> RESOLUTION NO.#5/cRA/(p <br /> A RESOLUTION to reconstruct a thirty inch (30") sewer line in the vacated Everett Ave. right- <br /> of-way between Federal Ave. and Nassau St. <br /> WHEREAS,the Utility Division of the Public Works Department has investigated and <br /> identified a structural deficiency in the 30" sewer line in a vacated portion of Everett Ave.; and <br /> WHEREAS, the adjacent property owners Mobil Oil and American Distributing have <br /> been identified as Potential Liable Parties (PLP) in a joint investigation by the U. S. Coast Guard <br /> (U.S.C.G.) and Department of Ecology (D.O.E.)that has found petroleum contaminated soils; <br /> and <br /> WHEREAS, the 30" sewer line damage needs immediate attention to maintain the <br /> integrity of the sewer line, prevent possible settlement problems and additional pollution of the <br /> Port Gardener Bay; and <br /> WHEREAS, the Utility Division has discussed this problem with the D.O.E., U.S.C.G. <br /> and P.L.P's and reached a verbal agreement as to the share of responsibility for the repair work to <br /> be based on investigations to be done as a part of the preliminary repair work; and <br /> WHEREAS, the Utility Division of the Public Works Department recommends that <br /> Council declare this an emergency; and <br /> WHEREAS, funds are budgeted for such repair work by the Utility Division <br /> NOW THEREFORE, be it resolved by the City Council of the City of Everett that an <br /> emergency is declared to exist and the Director of the Public Works Department is hereby <br /> thorized to contract for reconstructing the sewer <br /> au • - <br /> Councilp- son Introducing resolution <br /> PASSED and APPROVED this 4 2' day of>"),/€4..1996 <br /> Council President <br /> tt:res396 <br />
