fw " RETT RESOLUTION NO. 4113 A RESOLUTION for the proposed vacation of a portion of(unopened) 104th St. SE and 105th St. SE,Silver Lake Garden Tracts,Everett WA, described as follows: PROPOSED VACATION OF PORTION OF 104TH STREET SOUTHEAST: A tract of land in the Southeast quarter of the Northeast quarter of Section 19, Township 28 North, Range 5 East, W.M., said tract being a portion of 104th Street Southeast as dedicated to the public on the plat of Silver Lake Garden Tracts recorded in Volume 8 of Plats, page 17, records of Snohomish County, Washington, being more particularly described as follows on attached Exhibit A: PROPOSED VACATION OF PORTION OF 105TH STREET SOUTHEAST: All that portion of Lot 8, Block 2, Silver Lake Garden Tracts, according to the plat thereof recorded in Volume 8 of Plats, page 17, records of Snohomish County, Washington, conveyed to the City of Everett By Statutory Warranty Deed under Auditor's File No. 8810180400 and a portion of 105th Street Southeast as dedicated to the public on said plat of Silver Lake Garden Tracts, being more particularly described as follows on attached Exhibit B: WHEREAS, the owners of more than two-thirds of the front footage of those portions of said right-of- way and shown on the attached sketch, have petitioned for the vacation of said right-of-way; WHEREAS, R.C.W. 35.79.010 provided that City Council shall, by resolution, fix a date for public hearing on said petition; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF EVERETT that a public hearing be set for the 31st day of May, 1995, at 7:00 P.M. in the Snohomish County Administration Building, 3000 Rockefeller Ave., Ginni Stevens Memorial Hearing Room, Main Lobby in the City of Everett, to consider the proposed vacation of aforesaid right-of-way as herein described. -Z___ Z-.. _ ---V ---) Councilperson Int disci Resolu p g eso u ion PASSED AND APPROVED this 10 day of May , 1995. t 4 /11) y)6-2,- Council President KTagendal..doc
