ORDINANCE NO. 2871-05 AN ORDINANCE providing for the vacation of all of that portion of 1051' Street SE lying between Block 1 and Block 2, Plat of Silver Lake Garden Tracts, according to the plat thereof, recorded in Volume 8 of Plats, Page 17, records of Snohomish County, Washington; described as follows: BEGINNING at the Southwest corner of Lot 17, Block 1 of said plat; THENCE, East along the South line of said Lot 17 and Lot 18 to the Southeast corner of said Lot 18; THENCE, South along the Southerly projected East line of said Lot 18 to the Northeast corner of Lot 3, Block 2 of said plat; THENCE, Westerly along said North line of said Lot 3 and Lot 4 to the Northwest corner of Lot 4, Block 2 of said plat; THENCE, North along the Northerly projected West line of said Lot 4 to the Southwest corner of Lot 17, Block 1 of said plat, and the POINT OF BEGINNING WHEREAS the City Council of the City of Everett, did by Resolution No. 5207 duly adopt and fix the 10`1' day of July, 2002 at 8:30A.M., as the date of public hearing; and WHEREAS, due and legal notice of the time and place of said hearing and determination of said Resolution has been given by the City Clerk in the manner prescribed by law; and and WHEREAS, at the time and place fixed for hearing, the issues were publicly presented; WHEREAS, the City Council finds it would not vacate said rights of way could it not retain easements for utilities in said street to be vacated; and WHEREAS, it now appears to the City Council of the City of Everett that the said rights of way resolved to be vacated should be vacated pursuant to the terms and conditions of this ordinance: NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the following described rights-of-way: all of that portion of 10511 Street SE lying between Block 1 and Block 2, Plat of Silver Lake Garden Tracts, according to the plat thereof, recorded in Volume 8 of Plats, Page 17, records of Snohomish County, Washington; described as follows: BEGINNING at the Southwest corner of Lot 17, Block 1 of said plat; THENCE, East along the South line of said Lot 17 and Lot 18 to the Southeast corner of said Lot 18; THENCE, South along the Southerly projected East line of said Lot 18 to the Northeast corner of Lot 3, Block 2 of said
