‘171ELS ETT CITY OF EVERETT RESOLUTION NO. 3864 A RESOLUTION for waiving the public bidding requirements and for the sole source purchase from Diachem, Inc., for a continuing supply of Cationic Polyelectrolyte this year and next. WHEREAS, the Everett Filtration Plant had a need for liquid cationic polyelectrolyte to augment aluminum sulfate in the coagulation phase of the water treatment process; and WHEREAS, the Everett Filtration Plant determined that Diafloc 3495 increases the efficiency of the coagulation process and allows us to produce a higher quality and quantity of water than was previously possible; and WHEREAS, polyelectrolyte is fed at such infmitesimal rates that the efficacy of other brands can only be tested under full plant scale conditions; and WHEREAS, the Everett Filtration Plant will not be able to evaluate other brand name polyelectrolytes until plant expansion is complete; and WHEREAS, only Diafloc 3495 has proven efficacy in the coagulation of our raw water; and WHEREAS, Diafloc 3495 is available only from Diachem, Inc. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT pursuant to the attached memorandum the City hereby fmds that the purchase of cationic polyelectrolyte is legitimately limited to a single source, waives the requirement of calling for public bids for the acquisition of the subject cationic polyelectrolyte. Pursuant to RCW 35.23.352(9), the City hereby waives the requirement of calling for public bids for the acquisition of cationic polyelectrolyte for this year and next year. The City further fmds the purchase is clearly and legitimately limited to a single source of supply and that the cationic polyelectrolyte is subject to special market conditions. Cost of the cationic polyelectrolyte is approximately $90,000.00 each year. Council Person Introducing Resolution PASSED and APPROVED this 10th day of November , 1993 Council President
