EVERETT <br /> RESOLUTION NO. 3847 <br /> A RESOLUTION concerning the placement of political <br /> signs within the right-of-way. <br /> WHEREAS, the City Council finds that the City has <br /> historically prohibited the placement of political signs <br /> within the right-of-way based upon the interests of the <br /> general public including increased costs to the City, <br /> aesthetics, and traffic safety; and <br /> WHEREAS, the City Council finds that this prohibition exists <br /> within the City' s political sign regulations, EMC 19 . 36. 130; <br /> and <br /> WHEREAS, the City Council finds that due to a recent case, <br /> Collier v. Tacoma, 121 Wn. 2d 737 , the City' s prohibition of <br /> political signs within the right-of-way is called into <br /> question; and <br /> WHEREAS, the City Council finds that until the City formally <br /> addresses this issue through an amendment to the City' s sign <br /> regulations, a void exists relative to the City's enforcement <br /> authority of political signs within the right-of-way; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF EVERETT that the City Council prefers that political <br /> signs not be placed in the right-of-way; however, due to the <br /> circumstances presented by the Collier case, during this <br /> interim period, if candidates for public office or <br /> proponents/opponents of ballot measures place signs in the <br /> right-of-way, the City Council recommends that they carefully <br /> weigh their rights against the interests of the general <br /> public and limit the placement of such signs in the right-of- <br /> way; and should they use the right-of-way for the placement <br /> of their signs, that they extend the courtesy of obtaining <br /> the permission of the abutting property owner prior to the <br /> placement of any such signs. <br /> �►' Q Y <br /> ,fir•' <br /> yr <br /> Councilperson Introducing Reso ution <br /> c ` <br /> PASSED and APPROVED this 6th day of October, 1993 . <br /> Cou cil President <br /> signs2.ord.taq <br />
