111111. <br /> IFF <br /> RESOLUTION NO. j7.5/7 <br /> A RESOLUTION authorizing the sale of City Real <br /> Property generally located on Madrona Avenue <br /> WHEREAS, review of the property described in Exhibit "A" has been completed by all City <br /> Departments and Administration; and <br /> WHEREAS, the City Council finds and determines that the real property described in Exhibit "A" is <br /> not and will not be needed for City purposes; and <br /> WHEREAS, the City Council finds that the City has complied with the requirements of Section 15.8 <br /> of the City Charter and Resolution No. 1984; <br /> NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT <br /> as follows: <br /> 1) The real property described in Exhibit "A" is not and will not be needed for City purposes and <br /> is, therefore, declared to be surplus property. <br /> 2) City staff is hereby directed to resolve the issue of value diminishing encroachments by <br /> driveways benefiting adjacent property, either through removal of the encroachment or fair <br /> market value compensation for same. <br /> 3) The City of Everett will retain a utility easement and place a covenant on the deed to protect <br /> the existing Madrona tree on the property. <br /> 4) The real property described in Exhibit "A" shall be sold at a public sale by a competitive <br /> sealed bid process on the following conditions: <br /> a) The requirements of Resolution No. 1984 will be followed in the disposition of the real <br /> property described in Exhibit "A"; <br /> b)The real property described in Exhibit "A" shall be sold for cash at closing in the process <br /> detailed in Resolution 1984, except that the successful bidder shall be given ninety (90) <br /> days from the date bids are opened, to pay the full purchase price or deposit an additional <br /> 20% of the purchase price, as per Resolution 1984; <br /> c)The real property described in Exhibit "A" shall be sold to the highest responsive and <br /> responsible bidder, who is able to perform with cash at closing. Upon their request, the <br /> deposits of the second and third highest bidders may be held and their bids remain active <br /> through the time period allowed for the delivery of the full cash sales price by the highest <br /> bidder. Should the highest bidder not be able to perform within this time period, the next <br /> highest active bid shall become the highest bid and shall be given fifteen (15) days to <br /> deliver the full cash sales price; <br /> d)In the event two identical bids are received, the successful bid shall be deemed to be the one <br /> received first in time; <br /> e) The City Council reserves the right to reject any and all bids. It also reserves the right to <br /> waive any informalities in connection with said bid; <br />
