PZ--A <br /> 40FETT <br /> ORDINANCE NO. /973--9-' <br /> AN ORDINANCE relating to Prostitution, adopting Stay out of Areas of <br /> Prostitution (SOAP) Orders, adding a new section to the Everett Criminal <br /> Code, EMC 10.24.210. <br /> WHEREAS, the City Council has heard testimony from City of Everett <br /> Police Officers and from the Everett City Prosecutor concerning the scope <br /> and magnitude of the prostitution problem in those areas of the City of <br /> Everett set forth in the ordinance and that the frequency of prostitution <br /> activities in those areas occurs at all hours of the day and night - seven <br /> days a week, and that within these areas are bars, taverns, motels and <br /> rooming houses most frequented by area prostitutes and their customers. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. A new section is added to the Everett Criminal Code, Title 10 <br /> to be entitled Stay out of Areas of Prostitution Orders and codified as EMC <br /> 10.24.210. <br /> Section 2. STAY OUT OF AREAS OF PROSTITUTION ORDERS . <br /> 1 . Stay out of Areas of Prostitution Orders, hereinafter known as <br /> "SOAP" orders may be issued by the Everett Municipal Court to anyone <br /> charged with prostitution, soliciting for a lewd act, prostitution loitering or <br /> patronizing a prostitute under Chapter 10.24 of the Everett Municipal Code <br /> as a condition of pre-trial release. <br /> 2. SOAP Orders may be issued by the Everett Municipal Court to <br /> anyone convicted of prostitution, soliciting for a lewd act, prostitution <br /> loitering or patronizing a prostitute under Chapter 10.24 of the Everett <br /> Municipal Code as a condition of probation. <br /> 3. Whenever a police officer shall have probable cause to believe that <br /> a person has received a SOAP order as a condition of pre-trial release or <br /> of probation and in the officer's presence is seen violating or failing to <br /> comply with any requirement or restriction imposed by the court as a <br /> 1 <br />
