Ordinance No. 2917-06 <br />An ORDINANCE establishing Fund No. 451, entitled <br />"Everett-Tulalip Joint Water Line Fund" to administer funds to be used <br />in meeting the City of Everett and The Tulalip Tribes obligations under <br />the Agreements dated September 16, 2005 and March 3, 2006 for the <br />building of a waterline between Everett and the Tulalip Reservation. <br />WHEREAS, on September 16, 2005, the City of Everett executed an agreement entitled, <br />"Agreement for Settlement, Water Supply, and Water Delivery System Between The <br />Tulalip Tribes of Washington And The City of Everett, Washington" in which the parties, <br />among other things, agreed to fund efforts for building a waterline between the City and <br />the Tulalip Reservation; and <br />WHEREAS, on March 3, 2006, the City executed an agreement entitled: "Interlocal <br />Agreement Between The Tulalip Tribes Of Washington And The City of Everett For <br />Managing The Construction Of The Everett To Tulalip Waterline" which established a <br />Joint Board between the two entities to develop a comprehensive mechanism to provide <br />financial, project budget, construction management, etc. for the proposed water delivery <br />system. <br />NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br />Section 1: <br />A special Enterprise Fund is hereby established as Fund No. 451, entitled "Everett- <br />Tulalip Joint Water Line Fund" to accomplish the actions authorized by this ordinance. <br />Section 2: <br />Authorization is hereby given to accumulate costs and collect proportionate shares of <br />total costs for the development and construction of the joint water line <br />Section 3: <br />Authorization is hereby granted to the Mayor, with the City's Chief Financial Officer and <br />Utilities Director as the alternate delegates to the board of directors, to assume full and <br />complete responsibility for conducting all tasks to accomplish the actions authorized by <br />this ordinance. <br />Section 4: <br />Severability. If any provision of this ordinance be declared unconstitutional or invalid by <br />any court of competent jurisdiction, it shall be conclusively presumed that this ordinance <br />
