' • - RESOLUTION NO.cf/ A Resolution to amend the final development plan of Evergreen Terrace Planned Residential Development (PRD 1-78) WHEREAS, on April 26, 1978, the Everett City Council passed Ordinance 512-78, which amended the official zoning map of the City of Everett and changed the zoning designation of the property known as "Evergreen Terrace PRD," more fully described in the legal description attached hereto, from R-2 Single Family High Density Residential to "R-2, Single Family High Density Residential/Planned Residential Development;" and WHEREAS, Ordinance 512-78 also set forth certain conditions for development of the aforementioned property in the form of a "development contract" of preliminary approval which was entered into on May 9, 1978- by the City of Everett Planning Director and the Applicant, Dee Hills; and WHEREAS, Evergreen Terrace Home Owners Association has purchased the property which is subject to Ordinance No. 512-78 and the development agreement of preliminary approval from Dee Hills' successors in interest; and WHEREAS, Evergreen Terrace Homeowners Association, as the current owner of the property, is desirous of proceeding with the development of the subject property and has sought some revisions in the development contract which have been incorporated in Addendum to Development Agreement of Ordinance No. 512-78; and WHEREAS, on August 5, 1989, application was made by Bob Champion, representing Evergreen Terrace Homeowners Association, to amend the Final Development Plan of Evergreen Terrace PRD; and WHEREAS, a public hearing was held before the City of Everett Land Use Hearing Examiner on February 7, 1989, and at this public hearing public testimony was received; and WHEREAS, on February 24, 1989, the Hearing Examiner issued written findings, conclusions, and recommendations to Everett City Council.
