1 RESOLUTION NO. 3 /47// <br /> 2 A RESOLUTION establishing a policy for the retirement of Police <br /> 3 K-9 Officers. <br /> 4 WHEREAS, the City Council finds that the Police Department acquires and <br /> 5 trains dogs called police K-9 officers for the purpose of assisting the <br /> 6 Police Department; and <br /> 7 WHEREAS, the City Council finds that Section 15.8 of the City Charter <br /> 8 sets forth a procedure for the surplussing and sale of all City real and <br /> 9 personal property which the City no longer uses or needs; and <br /> 10 WHEREAS, the City Council finds that based upon the Snohomish County <br /> 11 Superior Court case of Bournique v. City of Everett, et al . , that for <br /> 12 property purposes dogs maintain a unique status and do not constitute <br /> 13 personal property; and <br /> 14 WHEREAS, the City Council finds that upon retirement of these K-9 <br /> 15 officers from the City's Police Department, that it is inappropriate to <br /> 16 utilize the surplusing procedures due to the unique status assigned to these <br /> 17 animals under the law; <br /> 18 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EVERETT DOES HEREBY <br /> 19 RESOLVE that the Mayor and Police Chief are hereby authorized to promulgate <br /> 20 a procedure for the placement of K-9 officers which retire from the Police <br /> 21 Department to ensure that the placement is in the best interest of said <br /> 22 animals. <br /> 23 <br /> 24 „,e„,7"`-'.. <br /> ,-�,�,/� <br /> 25 Councilperson Introducing Resolution <br /> 26 PASSED and APPROVED thi s o2, day of Mx/we-iv , 1989. <br /> 27 <br /> efAc: <br /> 28 Council Pres dent <br /> 29 <br /> 30 (3745) <br /> 31 <br /> 32 <br />
