CITY <br /> DEVELOPMENT AGREEMENT <br /> THIS AGREEMENT is entered into this day of dU ll - 2017, by and between <br /> Builders Investment Group LLC and 19th Ave Professional Center LLC (hereinafter, "the <br /> owners"), and the City of Everett, a municipal corporation under the laws of the State of <br /> Washington(hereinafter"the City"). <br /> RECITALS <br /> A. The owners own two contiguous parcels of land containing approximately 1.9 acres of <br /> real property, at 12704 and 12728 19th Avenue SE, (hereafter"the property"),the map of which <br /> is contained in Exhibit 1, and the legal description of which is contained in Exhibit 2. Any <br /> conflict between the legal description and map shall be resolved by referring to the map; <br /> B. This Agreement sets conditions of use and development standards to be applied to the <br /> property; <br /> C. This Agreement replaces and supersedes the conditions listed in City of Everett <br /> Resolution 5076. <br /> D. This Agreement is entered into pursuant to RCW 36.70B.170, 180, and 190. <br /> PART ONE—PROPERTY USE AND DEVELOPMENT STANDARDS <br /> 1.1 The property is zoned C-1 (General Commercial) and is restricted to office and clinic <br /> uses only. No other uses associated with the C-1 zone shall be permitted. <br /> 1.2 Placement of buildings shall be setback 10 feet from the property line on 19th Avenue SE. <br /> 1.3 The building facade facing 19th Avenue SE on parcel 280530-004-001-00 shall be at least <br /> 60 percent transparent glass windows and/or doors, and shall have a prominent entry with <br /> a"coved" entrance that is connected to the sidewalk on 19th Avenue SE. <br /> 1.4 The building facade facing 19th Avenue SE on parcel 280530-004-002-00 shall be <br /> finished with high quality materials, including transparent glass windows and/or doors, <br /> and shall be of compatible architectural treatment to the building on parcel 280530-004- <br /> 001-00, as determined by the Planning Director. <br /> 1.5 All lighting shall be directed or shielded so that they do not shine directly on abutting <br /> residential properties. <br /> COMP 16-001/REZ 16-001 Development Agreement Page 1 of 7 <br />
