• 1 ORDINANCE NO. 1135-90 2 3 AN ORDINANCE establishing the Grade and establishing the Design for 16th Ave. S.E. , from approximately 1450 feet North of 4 112th St. S.E. Northerly to the vicinity of the 101st St. S.E. grid and the South half of 102nd St. S.E. ; 105th St. 5 S.E. from 19th Ave. S.E. West approximately 1100 feet; and 106th St. S.E. West approximately 1100 feet; and 6 establishing permit fees for improvement of streets and utilities thereon. 7 8 WHEREAS, Ordinance No. 1552-88, for Local Improvement District 727 for 9 the construction of street, water and sewers on 16th Ave. S.E. lacks 10 jurisdiction to proceed based on over 60% protests; and 11 WHEREAS, the City has expended public funds to set the grade and to 12 design water, sewer and street improvements at a cost of $52,207; and 13 WHEREAS, the City has claimed proprietary interest in said plans which 14 require payment prior to use which the Council finds is inconvenient for 15 property owners who generally desire to finance and pay for use of said 16 plans and design at the time construction permits are issued; and 17 WHEREAS, the Council finds that the plans and the design and grades 18 should be made generally available (rather than treated on a proprietary 19 basis) in order to expedite coordination of street and underground utility 20 construction in the 16th Avenue S.E. area; 21 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 22 Section 1 : There is hereby added to the plan review and permit fees 23 for private work on public right-of-way, pursuant to Ordinance No. 921 -83, 24 or as such may be amended, and to the sewer and water utility connection 25 fees, pursuant to Ordinance No. 1171 -85, or as such may be amended; the 26 following permit charges for parcels in the area described in Exhibit A 27 hereto and as shown on the map shown in Exhibit B: 28 29 Parcel No. Surcharge 30 1 $3,520 2 4,390 31 3 27 4 175 32 5 2,113
