1 ORDINANCE NO. 1726-90 <br /> 2 <br /> 3 AN ORDINANCE relating to the sale and use of malt liquor in kegs, <br /> amending Section 1 of Ordinance No. 1243-86 (EMC Chapter <br /> 4 10.43) , adding a new section to Ordinance No. 1243-86 (EMC <br /> Chapter 10.43) and repealing EMC 10.43.030, a part of <br /> 5 Section 1 of Ordinance No. 1243-86. <br /> 6 <br /> 7 WHEREAS, the State has preempted the entire field of keg registration; <br /> 8 and <br /> 9 WHEREAS, it is desirable to be consistent with State law relating to <br /> 10 the sale and use of malt liquor in kegs; <br /> 11 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 12 Section 1 : EMC 10.43.010, part of Section 1 of Ordinance No. 1243-86, <br /> 13 which reads as follows: <br /> 14 Seller' s Duties <br /> 15 Any person who, sells or offers for sale the contents of <br /> 16 kegs or other containers containing six (6) gallons or more of <br /> malt liquor, or leases kegs or other containers which will hold <br /> 17 (6) gallons of malt liquor, to consumers who are not licensed <br /> under Chapter 66.24 RCW shall do the following for any <br /> 18 transaction involving said container: <br /> 19 1 . Require the purchaser of the malt liquor to sign a <br /> declaration and receipt for the keg or other container <br /> 20 and/or beverage in substantially the form provided herein. <br /> 21 2. Require the purchaser to provide two pieces of <br /> identification, one of which is a motor vehicle operator's <br /> 22 license, Washington State identification card, or military <br /> identification card. <br /> 23 3. Require the purchaser to sign a sworn statement, under <br /> 24 penalty of perjury, that: <br /> 25 a. The purchaser is of legal age to purchase, possess or <br /> use malt liquor; <br /> 26 b. That the purchaser will not allow any person under <br /> 27 the age of twenty-one (21 ) to consume the beverage <br /> except as provided by RCW 66.44.270; <br /> 28 c. That the purchaser will not remove, obliterate, or <br /> 29 allow to be removed or obliterated, the <br /> identification number affixed to the container. <br /> 30 4. Require the purchaser to state the particular address where <br /> 31 the malt liquor will be consumed, or the particular address <br /> where the keg or other container will be physically located. <br /> 32 <br />
