1 ORDINANCE NO. 1725-90 2 AN ORDINANCE relating to the Washington Model Traffic Ordinance 3 and State provisions, adding a new section to Ordinance No. 459-77 (EMC Chapter 46.04 - Washington Model Traffic 4 Ordinance and State Provisions) . 5 6 WHEREAS, the Model Traffic Ordinance does not include all sections of 7 the traffic laws which the City of Everett investigates and enforces; and 8 WHEREAS, it is desirable to be consistent with State law in the 9 enforcement of traffic laws relating to unfair business practices and 10 dealer's licenses under RCW Chapter 46.70; and 11 WHEREAS, RCW 46.80.150 requires the Everett Police Department to 12 periodically inspect motor vehicle wreckers' licensed premises, but the 13 Model Traffic Ordinance does not include the majority of the provisions of 14 RCW Chapter 46.80 (Motor Vehicle Wreckers) ; 15 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 16 Section 1 : New Section Added. 17 A new section is hereby added to Ordinance 459-77 (EMC Chapter 46.04) , 18 as follows: 19 Certain RCW sections adopted by reference. 20 The following sections of the Revised Code of Washington as now or 21 hereafter amended, are hereby adopted by reference as a part of this chapter 22 in all respects as though said sections were set forth herein in full : RCW 23 46.70.011 , 46.70.021 , 46.70.023, 46.70.027, 46.70.083, 46.70.090, 46.70.120, 24 46.70.140, 46.70.160, 46.70.170, 46.70.180, 46.70.260, 46.70.290, 46.70.900, 25 46.80.005, 46.80.020, 46.80.050, 46.80.080, 46.80.090, 46.80.130, 46.80.140, 26 46.80.150, 46.80.160, 46.80.170, and 46.80.900. 27 Section 2: Severability. 28 Should any section, subsection, paragraph, sentence, clause or phrase 29 of this ordinance or its application to any person or situation be declared 30 unconstitutional or invalid for any reason, such decision shall not affect 31 the validity of the remaining portions of this ordinance or its application 32
